INAYA LINGERIE SARL (trade name of Inaya Lingerie) is the seller of products and services present on the site.
The merchant site inaya-lingerie.com (hereinafter "the Site") is an e-commerce site accessible via the Internet network, open to any user of this network.
It is operated by the company INAYA LINGERIE, for the brand Inaya Lingerie, with a capital of 500 euros, registered at the Paris Chamber of Commerce under the registration number 839 276 326, whose registered office is located at 2 rue de Vienne 75008 Paris.
The managers of the company are Mrs Safia Ayad and Mr Guilhem Guinot.
The Site allows INAYA LINGERIE to offer its products (hereinafter "the Products") for sale in France and abroad.
The Site is for private individuals only and is prohibited to professionals.
The present General Terms and Conditions of Sale (hereinafter "GTC") govern the use of the Site and the services (hereinafter "the Services") that may be offered on it, as well as any purchase that may be made on the Site.
Any use of the Site implies the Customer's full and total acceptance of these GTC.
In case of modification of these GTC, the applicable GTC are those in force at the date of use of the Services or when placing the order.
These GTC are available in French and English. The French version shall prevail in case of any discrepancy.

Art. 1: Products
The essential characteristics of the Products are presented on the Site in each of the Product sheets.
The customer is fully informed that the images, photos and colors of the items for sale may not correspond to the actual colors, depending on the Internet browser and the screen used.
The products for sale on the Site are available within the limits of available stocks.
If one or more ordered items are no longer available, the Customer will be informed by e-mail as soon as possible.
The Customer may then cancel the order of the article or articles concerned and be refunded, where applicable, the sums already paid, by crediting the bank account corresponding to the bank card used for payment at the latest within 30 days.
Art. 2: Prices
The prices of the Products sold on the Site are indicated by article and reference. They are mentioned in euros.
The prices of the products are those indicated on the Site whatever the place of delivery and are understood all French taxes included (TTC). However, shipping costs, which are the responsibility of the Customer (see Art. 8 for more information on shipping costs), are excluded.
It is specified that the customs duties and possible taxes requested at the time of delivery in certain countries in which the Products are likely to be delivered, are not included in the prices and are the responsibility of the customer (see Art. 9 for more information on customs duties when returning one or more products).
Any change in the statutory VAT rate applicable will automatically be reflected in the prices of the items as soon as it enters into force.
The applicable prices are the prices displayed on the Site when placing the order.
Art. 3: Order - Stages of the sale process
1- The Customer enters the URL www.inaya-lingerie.com
2- The Customer adds the items to his shopping cart.
3- The Customer checks the items in his order, identifies and corrects any errors made during entry by issuing an order summary.
4- The Customer expressly verifies and accepts Inaya Lingerie's General Terms and Conditions of Sale.
5- The Customer validates the order, the total price and the all-inclusive price, by clicking on "Pay my order".
6- The Customer receives an electronic receipt containing the elements of his order. The order will then only be confirmed after acceptance of payment by the Customer's bank and receipt of the order amount by INAYA LINGERIE.
7- The Customer receives an electronic confirmation of his order.
8- The Customer receives his parcel at the address of delivery he indicated when he placed his order, or in a relay point.
Any order will be validated only after acceptance of payment. After payment, an order confirmation is sent by INAYA LINGERIE to the Customer by e-mail to the e-mail address indicated by the latter.
The Customer accepts that the invoice is considered as proof of the contractual relations between the parties. The Customer will be able to print the invoice sent with the order confirmation.
Art. 4: Retention of Title
The Products shall fully remain property of INAYA LINGERIE SARL until the agreed price for the Product has been paid in full by the Customer.
Art. 5: Payment terms
Payment shall be made in full when placing the order. The sums paid shall in no case be considered as a deposit or advance payment. No cash on delivery shall be accepted under any circumstances.
The Customer pays his order by card (Visa, Eurocard/MasterCard) via the secure PayPal platform (www.paypal.com).
The Site www.inaya-lingerie.com has a security system to protect as effectively as possible all sensitive data related to the means of payment used on the Site.
In accordance with Article L. 132-2 of the Monetary and Financial Code, the commitment to pay by card is irrevocable.
Any order placed on the Site implies that the Customer is legally entitled to use the payment methods available on the Site.
INAYA LINGERIE SARL reserves the right to suspend or cancel any order if any sums payable by the customer cannot be paid.
The data will be securely stored by INAYA LINGERIE SARL and will not be disclosed under any circumstances.
Art. 6: Anti-fraud
INAYA LINGERIE SARL shall cancel or refuse any order from a Customer with whom there would exist a dispute relating to the payment of a previous order.
The resale of products purchased on the Site is strictly forbidden. As such, each order is limited to a maximum of 20 products.
In addition, INAYA LINGERIE SARL employs a system of exclusion lists, which may lead it to:
(I) request certain supporting documents once payment has been made in order to secure the transaction, in the event of an automatic alert triggered by information relating to the order.
(II) block any transaction made from a Customer account with previous fraudulent history.
Art. 7: Delivery
For all orders placed on the Site, we will prepare your order for shipping in 24-96 hours (excluding weekends and public holidays) and in maximum 10 working days during busy periods (Christmas, sales, etc.).
When placing an order, the Customer will choose a delivery method offered on the e-shop site:
- Tracked parcel, Colissimo, for delivery in metropolitan France, Corsica or internationally. The shipping costs are calculated according to the delivery address indicated by the customer and vary according to the geographical area.
Shipping is free for orders over 200€ for France, Belgium, Germany, the Netherlands, Spain, Italy and Austria and over 300€ for all other shipping countries.
For residents outside the European Union, the Customer is responsible for customs charges related to the shipment of the order.
The Customer may request the ordered items to be delivered to his home, office, third party, holiday location, etc. He can also have the items delivered to any natural person of his choice.
In case of error on the recipient's address label, INAYA LINGERIE shall not be held responsible for failure to deliver the order(s).
If the Customer is absent upon a Colissimo delivery at the address he specified, a delivery notice should be left: The Customer can then collect his parcel at the Post Office upon presentation of an identity document within 15 days following the date of the deposit of this notice.
After this period, the parcel will be returned to INAYA LINGERIE. The Customer Service can then contact the Customer for a possible reshipment at the expense of the Customer. If the Customer does not answer, the order will be refunded.
When a parcel is dispatched from the warehouses of the company INAYA LINGERIE to be sent to the address indicated by the Customer when ordering, the latter will receive an electronic confirmation of shipment from the Site, on which is indicated the tracking number of his parcel.
The Customer can track his order with his tracking number on the websites of the Post Office:
Each shipment is deemed to be made as soon as the product is made available to the Customer by our carriers, evidenced by the shipment tracking available on the websites of our carriers mentioned above.
If 7 business days after the shipment of the parcel, the Customer still hasn't received any information about his order, he should contact the closest Post Office to the place of delivery.
If neither the Post Office nor the delivery tracking system offered on the websites of our carriers mentioned above have records of this parcel, the Customer shall then contact INAYA LINGERIE through the Customer Service, which will then open an investigation with the competent services.
The final response times of our carriers vary from one to three weeks after the request has been taken into account by INAYA LINGERIE.
At this stage, the Customer may cancel his order with the Customer Service because of the delay and request a refund. The parcel, if found, will be returned to INAYA LINGERIE.
On the contrary, if the Customer wishes to maintain his order and receive his product despite the delay:
- If found, the parcel will be sent to the Customer: the process is then the same as mentioned above (delivery or delivery notice)
- If reported lost (the final answer is often given within the maximal deadline, that is to say, three weeks), INAYA LINGERIE notifies the Customer and immediately engages the refunding of the parcel (products and shipping costs).
INAYA LINGERIE is relieved of its obligation to deliver in case of force majeure, such as, amongst other, war, riot, fire, flood, strikes, accidents, the impossibility of being supplied.
In all circumstances, delivery of our products on time can only occur if the Customer is in compliance with his obligations.
It is up to the Customer to check the shipments upon reception and to formulate any reservations or complaints which seem justified, or even to refuse the parcel if it is likely to have been opened or if it bears obvious signs of deterioration.
Those reservations and complaints must be directly addressed to the Post Office by registered letter with acknowledgment of receipt.
Art. 8: Returns
The legal withdrawal period in accordance with the Consumer Code is 14 clear days, without having to justify reasons or pay penalties. This period begins from receipt for the Products or acceptance of the offer for the Services.
To submit a request to get a credit or a refund on our eshop, the Customer should contact INAYA LINGERIE at firstname.lastname@example.org.
He must indicate the reasons of the return and specify if he wishes a credit note (in case of exchange) or a refund (in case of final return). He should also specify which articles are concerned. The Customer will then receive a return or refund confirmation, along with instructions on how to ship us the Product(s) back.
The Product(s) are to be returned to ADRESSE A CHANGER at the expense of the Customer, including any customs fees.
The risks arising from returns are the Customer’s responsibility. The Customer is thus strongly encouraged to return the parcel by any means which brings a proof of its sending and gives a certain date (registered with acknowledgement of receipt, Colissimo with tracking, etc.). The Product must be returned in its original condition and packaging together with the return form, to the address indicated on the shipment note.
If the parcel is returned without the return form, INAYA LINGERIE will not be able to proceed to the refunding or the creation of a credit note of the returned Products.
Products returned incomplete, damaged, worn or soiled will not be accepted.
In case of a refund request:
The Products returned will be refunded to the Customer within a maximum period of thirty days after they have been received by INAYA LINGERIE.
Once the Products have been received, checked and accepted by our services, the refund of the Products returned will be made at the invoiced price by crediting the amount to be refunded to the Customer's bank account debited during the transaction.
In case of a credit note request:
The exchange will consist of a credit note equal to the sum of the amount of the Products and valid for 3 months. You’ll receive a credit code by e-mail as soon as the unwanted Products are received. This credit note can only be used once. Any unused balance will be lost.
Art. 9: Legal guarantee
The Products benefit from guarantees of conformity and hidden defects.
Without prejudice to the withdrawal period mentioned in article 8, if the delivered articles do not conform in kind or in quality to the specifications indicated in the shipment order, the Customer should notify the Customer Service by writing at email@example.com.
He will then receive a return form by email, which he will print.
The Product must be returned in its original condition and packaging together with the return form, to the address mentioned on the return form.
If the parcel is returned without the return form, INAYA LINGERIE will not be able to proceed to the exchange of the returned product. The shipping costs of the return parcel will be refunded to the Customer, by a credit of the amount to be refunded on the bank account of the Customer debited during the transaction.
Once the Product has been received, checked and accepted by our services, INAYA LINGERIE will send a new Product corresponding to the Customer's order and in conformity with the Product description.
If the Product is no longer available, INAYA LINGERIE will notify the Customer by email and offer a credit note or a refund of the amount of the returned Product.
You’ll receive a credit code by e-mail as soon as the unwanted Products are received.
The refund of the returned Product will be made at the invoiced price by crediting the amount to be refunded to the Customer's bank account or PayPal account (depending on the original method of payment) debited during the transaction.
The withdrawal period does not begin again after receipt of the new Product.
Art. 10: INAYA LINGERIE’s responsibility
INAYA LINGERIE cannot be held responsible if the Site is inaccessible or presents any irregularities or bugs for any reason.
INAYA LINGERIE reserves the right to put a third party on the Site in any manner whatsoever and is not responsible for third party sites to which visitors are directed from the Site.
Confidentiality of personal data:
The personal data collected on the Site www.inaya-lingerie.com are necessary to process the order.
When a Customer places an order on the Site, the database is updated with information concerning the Customer, which will then enable the Customer to better meet his expectations and facilitate the assistance services provided by our Customer Service.
According to the French Data Protection Act of January 6th, 1978, the Customer has the right to access the personal data we may hold about him that he can exercise by writing to the Customer Service at firstname.lastname@example.org, without prejudice to the rights and remedies it otherwise holds.
Intellectual property rights:
All the Products, as well as the texts, comments, photographs, brands, designs, concepts, illustrations and pictures to be found on the Site are the exclusive property of INAYA LINGERIE and are protected by the intellectual property rights in France and all around the world.
Any reproduction, in whole or in part, of these elements is strictly prohibited.
Applicable law and jurisdiction:
If the Site and GTC are translated, the French version prevails in case of any discrepancy.
These GTC are subject to French law. Any dispute arising as to their validity, interpretation and execution shall be submitted to the exclusive jurisdiction of the Paris courts, unless otherwise required by mandatory procedural rules.
